DVSA makes temporary changes to Enforcements Sanctions Policy regarding overweight vehicles

Due to exceptional circumstances surrounding the COVID-19 outbreak, the Driver and Vehicle Standards Agency (DVSA) has authorised temporary changes in enforcement for overweight vehicles for UK and non-UK drivers. The temporary change will apply until further notice.

This change means that drivers of vehicles that are 30 per cent or more overweight will now receive only a penalty rather than a prosecution through the Court system. The change is supported by The Road Safety (Financial Penalty Deposit) (Appropriate Amount) Order 2009, Table 5, Section 41B Road Traffic Act 1988.

As per usual protocol, GB operator licence holders will be reported via the Traffic Commissioners for appropriate regulatory action.

The change will be kept under review and the DVSA reserves the right to prosecute the most serious offences.
